A woman was in a training class at her job and was absolutely and totally berated, abused emotionally, verbally abused, and thrown out of the training class in front of 30 of her peers. She suffers from nightmares, agoraphobia and inability to live her life the way it formally was. She’s now in psychological counseling, and taking medication. Does she have a claim? Under Florida law? NO!
Florida law does not require that your boss has to be nice to you. I can walk in my office every day and call my secretary every name under the sun and as long as I don’t relate it in any way to her membership in a protected classification (remember protected classes are age, race, gender, religion, nationality, disability, HIV status or Marital status) there is not one thing she can do about it. There’s no discrimination claim…..there’s no retaliation claim……..there’s no assault claim, no battery claim and no defamation claim… There is simply no claim under Florida law.
